in the case prescribed under subparagraph (2)below):-
a)For an aircraft other than a glider-Analtitude of 500 meters or more from the top of the highest obstacle within a 500-meter radius from the aircraft;
b)For a glider - An altitude of 300 meters or more from the top of the highest obstacle within a 300-meter radius from the glider;
(2)An altitude from where there is no possibility that the shock wave caused by the aircraft can inflict injury or damage to a person or object on the ground or over the water, in the case of ultra high-speed flight as specified under Article 197-(4).

 

(Permissible Flight Visibility for Engaging in Acrobatic Flights etc.)
Article 197-(2). The distance specified in Ordinances of the Ministry of Transport under Article 91 paragraph 1 of the law shall be as prescribed in the following subparagraphs:
(1)The distance prescribed below corresponding to the classification of the airspace in which the flight takes place, in the case of an acrobatic flight as specified in the following Article, or a test flight (except in the case prescribed under subparagraph
(2)below:-
a)8,000 meters - Where the airspace is at an altitude of 3,000 meters or higher; b)5,000 meters -Where the airspace is lower than 3,000 meters;
(2)10,000 meters - In the case of ultra high-speed flight as specified under Article l97-(4).

 

(Acrobatic Flight)
Article 197-(3). Acrobatic flights as specified in ordinances of the Ministry of Transport under Article 91 paragraph 1 of the law shall comprise loops, rolls, reversion, inversion spins, hip stalls and other sequences of related flights accompanying steep changes of aircraft attitude, unusual aircraft attitudes or inordinate changes of aircraft speed.

 

(Flight at Ultra High Speed)
Article 197-(4). Ultra high-speed flight as specified in Ordinances of the Ministry of Transport under Article 91 paragraph 1 of the law shall be any flight at a speed exceeding the speed of sound.

 

(Application for Permission for Acrobatic Flights etc.)
Article 198. Any person who intends to obtain permission under the proviso of Article 91 paragraph 1 of the law shall submit to the Minister of Transport an application describing the following items:
(1)Name and address;
(2)Type of aircraft, the nationality and registration mark of the aircraft;
(3)Summary of flight plan (indicating clearly the purpose, date and route of the flight);
